MANILA - The Sandiganbayan 7th Division has denied the motion of a convicted former official of the Department of Public Works and Highways (DPWH) for confinement in a medical facility because of his stage 2 prostate cancer.
In a resolution, the anti-graft court noted the finality of the verdict handed down against former DPWH Bicol Regional Director Eleno Colinares.
Colinares was convicted of graft for having his office rent his own Mitsubishi Pajero in 2001. He was sentenced to six years in prison with perpetual disqualification from public office.
In its resolution, the court said he should serve his sentence in prison.
“While the court fully commiserates with the plight of the accused and acknowledges the urgency of the situation, he must, unfortunately, look elsewhere for relief," the court said in the minutes of the proceedings held on January 30, 2019.
"As it stands, considering the finality of the judgment of conviction, the court is without recourse but to order his commitment at the National Penitentiary, Muntinlupa City,” it said.
With the finality of judgment, the court said a mittimus or commitment order against Colinares shall be issued.
