Video of gunmen at hotel must be investigated, says Daraga mayor lawyer

MANILA—The camp of Daraga, Albay Mayor Carlwyn Baldo has filed a motion for subpoena to retrieve the CCTV footage of a hotel where the alleged gunmen stayed on the eve of the murder of Ako Bicol Partylist Rep. Rodel Batocabe.

Atty. Lovinsky Fernandez, Baldo's legal counsel, identified the hotel as the Rosewood Inn, owned by the family of Daraga Vice-Mayor Victor Perete.

Fernandez said the Criminal Investigation and Detection Group (CIDG) mentioned the footage in the documents it submitted to the fiscal.

"Dapat ito sana inimbestigahan din ng CIDG. Sinabi nilang may CCTV footage, nag-file ako ng motion for subpoena para i-produce 'yan pero hindi na ako nabigyan ng pagkakataon," he told radio DZMM.

Fernandez said the motive behind Batocabe's slay was political and said it was connected to the construction of an international airport in the Albay town

"This is all about power grab, 'yung mga tunay na plotters nito wanted to seize political power sa local level ng Daraga, Albay. 'Yun lang po ang motibo dyan," he said.

"Ito hong pangyayari sa kasamaang palad kay Cong. Batocabe talagang connected 'yan sa international airport na 'yan, kung sino ang makikinabang sa international airport na 'yan. Sa pangyayaring ito lumalabas they’re hitting two birds with one stone by eliminating Batocabe, ituturo kay Baldo, tanggal sila pareho."

Fernandez, meanwhile, said his client will surrender should an arrest warrant be issued against him.

"Kung sakali pong maisyuhan ng warrant, matiwasay kaming susuko, dahil naniniwala po kaming walang kasalanan si mayor based po du'n sa physical evidence na nakalap na hindi tumutugma du'n sa sinasabi ng alleged gunman," he said.

Baldo on Friday asserted his innocence and asked President Rodrigo Duterte to order a review of the evidence allegedly linking him to Batocabe's murder.

Batocabe, 52, was planning to challenge re-electionist Baldo for the Daraga mayoralty in the midterm elections in May.

The lawmaker was distributing Christmas gifts in his hometown in Daraga, Albay on Dec. 22 when he and his police escort were gunned down by at least 6 assailants.
