MANILA (2nd UPDATE) - A Taguig court has issued an arrest warrant against Nicko Falcis, Kris Aquino’s former business partner, for access device fraud.
The Taguig Regional Trial Court (RTC) Branch 70 has recommended a P60,000 bail.
The Taguig City Prosecutor’s Office earlier recommended the filing of estafa and fraudulent use of access device cases against Falcis.
It, however, dismissed Aquino's qualified theft complaints against Falcis.
Aside from filing in Taguig, Aquino also charged Falcis in Pasig and Makati, where the respective prosecutor's offices also dismissed her qualified theft complaints.
Falcis' counsel Regi Ponferrada said they have filed an omnibus motion before the Taguig Metropolitan Court Branch 117 and Taguig RTC Branch 70 to defer the issuance or recall the arrest warrant "on the ground of absence of probable cause."
"We will verify if a warrant has been issued, but we hope the issuance of the same will be deferred in light of our motion," Ponferrada said in a statement.
Aquino had accused Falcis of making unauthorized purchases amounting to around P63,000 in different establishments in Taguig from June to August 2018 using the credit card entrusted him as managing director of Aquino’s firm, Kristina C. Aquino Productions (KCAP).
Falcis, meanwhile, claimed Aquino caused the issuance of the credit card for his use at his discretion and without need for Aquino’s approval.
